Why is the Question ?
Shipbreaking is mainly performed in four states of India namely Gujarat, West Bengal, Kerala and Maharashtra. The available shipbreaking capacity in India is approximately 4.5 million Light Displacement Tonnage (LDT). The shipbreaking process is hazardous since end-of-life vessels contain toxic materials such as polychlorinated biphenyl, polyaromatic hydrocarbons, asbestos, polyvinyl chloride, tin, lead, heavy metals and several other substances. Unregulated ship recycling may result in the release of toxic materials into the local environment which has damaging consequences on local communities, wildlife and agricultural practises. However, recycling of a ship enables the re-use of valuable materials and contributes towards stablishing a circular economy. Therefore, there has been a need to establish a framework for the recycling of ships in India. India is one of the world's largest ship recycling countries which has acceded to the Hong Kong International Convention for the Safe and Environmentally Sound Recycling of Ships (“Convention”). This Convention aims at ensuring that the recycling of ships that have reached the end of their operational lives do not pose any unnecessary risk to human health and safety or to the environment. Last year the Government of India enacted the Recycling of Ships Act, 2019 (“Act”). The preamble of this Act mentions that it is an Act to provide for the regulation of recycling of ships by setting certain standards and laying down the statutory mechanism for enforcement of such standards and related matters.
